Rules for the road: Xtream Members Online Marketing Digital Product Library Traffic Exchange Policies and Rules

We have established these rules to help make everyone's experience here the best experience possible. Xtream Members is provider of Digital Products, with onboard advertising available that include two traffic exchanges, a banner exchange, a text ad exchange, and a mini banner exchange. As we provide multiple services to the members, we have multiple Policies, Rules, and Terms of Services. All Members agree to abide by the Full Policies, Rules, and Terms of Services when they join Xtream Members.

Digital Products:

• Your account with Xtream Members and access to the Library is limited to you alone, and lasts for as long as you are a member of Good Standing.
  
• You may not share your account information to any 3rd party, or allow access to the Library or download product from the Xtream Members Library for any other person.
• All digital products are presented 'as is'. Xtream Members is not responsible for the content of any digital product.
  
• While we do our best to double-screen all product loaded to the Library for malicious scripts, adware, and/or Malware, Xtream Members is not responsible for any damage that may occur in downloading a product from the Library.
• Once a product is downloaded to your computer, that product becomes your own property to use, giveaway, or resell - according to the Rights attached to each product.
• You are responsible for knowing and abiding by the Legal Copyrights and Rights attached to each product.
  
• Xtream Members is not responsible or liable for the misuse of any product downloaded by any Member - past, present, and future - from the Xtream Members Digital Download Library.
• Xtream Members is not responsible for any litigation which may result from product abuse by Member - past, present, and future.
  

Earnings from Downline Subscriptions and Direct Xtream Members Product Sales:

• Xtream Members offer Affiliate Commissions based on the sales of Subscriptions to the Digital Product Library, as well as commissions based on any product sold from within the Xtream Members Digital Product Library. Earnings are accrued based solely on the Individual Members recruitment efforts, and include Subscriptions to Xtream Members Library made by your Downline Member, or sales of products purchased by your Downline Member from the Library itself.
• There are NO monetary earnings accrued from the Advertising Services, including the traffic exchanges. Members are NOT paid to surf, paid to advertise, paid to promote, or paid to click.
• Earnings from the Digital Library are determined by Member Level.
• Payout Level for subscriptions purchased by Downline Members is determined by Member Level.
• Once Payout Level is reached, the Member can request a Payout of Earnings.
• Please allow up to 30 days after Request for Payout for Admin to verify sales and earnings.
• Once Verified, Payouts are processed on the 5th Day of Each Month.

Xtream Members Traffic Station rules: Site and Ad content

The following restrictions apply to any page being promoted through Xtream Members Online Marketing Digital Product Library Traffic Exchange :

• Any code, intentional or accidental, which interrupts the flow of an autosurf browser:
  • Frame breakers are not permitted
  • Pop-ups, Pop-unders, slide-in windows are not permitted
  • Any script, image, or other element which causes a windows-dialog to appear, including but not limited to:
    • Automatic downloads
    • Automatic form submission
    • Blatant scripting errors
• Sites may not display any of the following types of material:
  • Illegal, hacking, warez
  • Pornographic, abusive, obscene or vulgar
  • Racism, Hate-mongering
  • Other material deemed by us to be objectionable
• Sites must be in English, or have an 'English version' function on them

Any site violating these rules will be suspended from rotation (taken off the tracks), and the member will receive a warning.  Blatant and/or repeated violation of content rules is grounds for account termination.

Rider rules: Restrictions on membership

• Members must join for themselves.  Any member caught filling in forms "on behalf of" another member will face immediate account closure.
• Membership is limited to one membership id per physical human being.  (In other words, different accounts under different email addresses that end up at the same person is a violation of our policies.)
• Members may only use one autosurf browser at a time.  No extra credits will be generated by opening a second autosurf browser to the same account.
• Members may not spoof or tamper with our autosurf browser.  Attempts to do so will lead to account termination, and potential membership banning (meaning you can't re-join).
• Members may not send Unsolicited Commercial Email (UCE or spam) promoting $SiteName in any way, shape or form.  We take spam seriously: if you don't have direct permission to send someone email, you may not advertise on our behalf.

Referrals page views for credits

You may show our referral page through other traffic exchanges.  In your weekly statistics report, you will also get ratios for referrals (how many views, versus how many unique views).  Credits are given in exchange for unique views in a 24-hour period.  We will attempt to store a cookie on the viewer's browser so you can qualify for referral credits from them if they join.

Referral credits

If a member signs up through your referral page, or through our main join screen within 30 days of viewing your referral page (meaning they have your cookie on their browser), you will receive credits when they join, and a percentage of their earnings or spend credited directly to your account.  For details, see the 'pricing / membership levels' page.

Once you have referral credit for a member, they become part of your "downline". 

Emailing your downline (and vice-versa)

In your weekly statistics, you will be notified of new referred members, and if they elected to receive mail from their upline (they get a surf bonus for doing so).

If your downline members permit it (they have the choice, when joining), you may send electronic mail to them through our 'mail your downline' form.  You may not send more than 1 mail per week, and you do not have access to their email address.

You can elect to show or hide your email address.  If you send a message to your downline, even with your email obscured, they can respond through our 'upline response' form.

Content of these emails is subject to the same rules as site content, with the following additional restrictions:

• Be aware that we will receive a copy of any email sent through this method for evaluation of content
• Content sent this way can only contain plain text - no graphics or attachments are permitted

Delivery of hits

We will make every effort to deliver hits to your approved sites as quickly as possible.  We make no guarantees of any kind that you will receive a given number of hits in a certain period of time. Delivery of Hits depends on the surfing habits of all members involved in the Traffic Exchange.

Account closure

You can elect to close your account at any time.  This is done through the members' area.  Be advised that Account Closure can be processed anywhere between 1 - 3 working days of the date of Closure by Admin. When you close your account, you lose all referrals and downline, and forfeit all earnings and credits. If you plan on closing your account, and are owed commissions on Subscriptions purchased by your Downline to the Digital Product Library, or commissions based on Products purchased by your Downline, ensure you request a payout before closure. As long as you have reached the payout level for your account that Request will be reviewed and Verified by Admin. Payment will then be scheduled for the 5th Day of the Following Month. Once the Account is closed and processed, you forfeit all referrals, credits, downline subscriptions, and earnings. Any product you downloaded to your own computer during your Membership to Xtream Global is yours to keep forever.

If closed by mistake, you can un-close an account by contacting Admin immediately. If the Closed Account has been processed, you forfeit all referrals, downline subscriptions, and earnings. They will not be re-instated. If the Account Closure has not been processed by Admin, there will be no loss of credits, referrals, or earnings.

Xtream Members personnel and Admin may also close any account if it is found to violate our policies, either with frame-breaking, popup technology, actions used to cheat the system and/or artificially boost credit counts, actions to damage either the operation or reputation of our site (including the use of UCE (spam)), or other actions deemed by us to be unsuitable for our membership.

When an account is closed, any remaining credits, referrals, and earnings are forfeited.  Referred members will rise to the closed member's upline referrer, or be listed as free agents.

Legal Disputes and Action:

Be advised that all Legal disputes and actions, including litigation and Court Proceedings will be conducted in the State of the Business Office, Xtream Global, which is located in the State of Texas, United States Of America. In case of Lawsuit or Legal Action instigated by Xtream Global, all parties will be subpoenaed to appear in a Court Of Law located in or convenient to:
