Terms

• Wherever in this document the word "we" or "us" is used, it refers to Xtream Members Digital Product Library website management. 
• Wherever in this document the word "you" is used, it refers to the member.

Acceptance of Agreement

By joining the Xtream Members Online Marketing Digital Product Library Traffic Exchange Digital Product Library Warehouse with separate Traffic Exchange and Advertising system, you are agreeing to the Terms and Conditions in this document, and agree to provide complete and accurate information about your yourself to us.

We reserve the right to alter or amend this agreement at any time, and to place the revised agreement at this same location, i.e. http://xtreammembers.com/Info/terms.php .

Description of Service

Basic membership is free: A Xtream Members Online Marketing Digital Product Library Traffic Exchange membership is a free service provided by us that serves two purposes:

1. Provide limited Access to the Digital Product Library to help you get started with a Digital Product Business, or to help you build any business or affiliate program of your choosing.
   
2. Bring internet traffic to the web pages indicated by you. 
   

All Members can earn commissions from Xtream Members when any member in their Downline subscribes to the Xtream Members Digital Product Library Warehouse or purchases an item that is for sale within the Xtream Digital Product Library. Earnings and Payout Levels are based on Member Level. All members keep 100% of any sale related to a product (or products) you download from the Library and then promote on your own. Xtream Members even provides free traffic and other online Advertising services to assist you in promoting the products you own.

The only requirements for this service are:

1. A verifiable email is provided - we will send an email containing a code which we must receive back, to verify the identity of the member.
2. Membership is limited to 1 membership per person.
3. We reserve the right to reject a membership application for any reason.
4. We reserve the right to 'ban' a member who has, repeatedly and/or deliberately violated any of our policies.

Internet Traffic: Traffic is defined as a 'visit' or 'hit' to a web page, performed by a member of our system, using a browser of their choice.  Traffic is delivered on an as-available basis.  No guarantee is made as to the rate at which traffic can be delivered to a site.  Each visit incurs a cost of 1 credit to the member. You are not paid to surf, nor do you receive any cash for doing so.

Credits: A credit enables a member to receive a visit to one of their listed sites.  Credits may be purchased or earned.  Credits are earned through auto surfing, manual surfing, and referral of other members.  Credits have no cash redemption value, and can only be used through the Xtream Members Online Marketing Digital Product Library Traffic Exchange site.  Unused credits do not accrue interest.

Referral of other members: We provide a link that a member can use to bring other people into our system.  If a visitor joins our system after visiting through a member link, the member providing the link will be credited with a referral.  This will result in the referrer receiving some percentage of credits earned by the newly referred member.  Referral credits are provided for the duration of the membership of the referrer. Xtream Members receive commissions on any subscriptions purchased by their downline to the Digital Library, and on any purchases made from the Library by a downline member. Xtream Members do NOT earn commissions from their own or their downline surfing activities. You do NOT get paid to promote. Commissions are earned on tangible products only.

Inter-member email: Members are permitted to send, through a form on our site, 1 text-based email per week to members they have referred if the referred member allows the receipt of such emails.  At no time will the referred member's email be exposed to the referrer.  The referrer may optionally disclose their email to the recipient.  Once a message has been sent, any member receiving the email can use the same form to respond to the originator.  This is a specialized service, designed to facilitate inter-member communications.

Subscription membership: Subscription to the Digital Product Library are available. Subscribers receive up to full access to every item in the Digital Product Library, with the exception of Paid Downloads. Most subscriptions also include enhanced advertising features or functions. Subscriptions are available on a month-to-month basis for a fee, or on Multi-Month Packages.  The fee is not prorated, and is not refundable.  Enhancements to the Advertising System come in the form of package deals, providing mechanisms to earn more credits per hour than an un-enhanced membership.  For a discussion of membership enhancements, their costs and benefits,  see our descriptions at:

Site acceptance

We reserve the right to reject any particular site for our system.  We have prepared guidelines for unacceptable websites, which can be found at http://xtreammembers.com/Info/policies.php .

Conditions of Use

By using this service, you agree that you will not attempt to undermine the integrity, appearance, or reputation of our site.

Termination of Agreement

Either party may terminate this agreement, with or without cause.  For you to terminate the agreement, simply log in and select "close account" in the member's area.  You can also choose to request Admin close your account for you. In the event an Admin or Other Representative for this site closes your account for you upon request, you forfeit all earnings, credits, member level, and downline. Depending on the circumstances, you can then be banned by Admin at this time to prevent you from rejoining at a future time. If we choose to terminate the agreement, you will be notified by email to your verified address, along with the reason for termination.

In the event of account termination, unused credits are discarded, and referral credits are removed.  All earnings accrued are forfeited. Members who you referred will be given to your 'upline' referrer, or moved to the 'free agent' pool, where other members can buy them into their downline.  Membership fees are not refundable, but if you have opted for the 'automatic monthly payment', it will be stopped by us as of the date of your account's termination.  If you are accidentally charged a membership fee after account termination, we will refund it promptly.

You can elect to close your account at any time.  This is done through the members' area.  Be advised that Account Closure can be processed anywhere between 1 - 3 working days of the date of Closure by Admin. When you close your account, you lose all referrals and downline, and forfeit all earnings and credits. If you plan on closing your account, and are owed commissions on Subscriptions purchased by your Downline to the Digital Product Library, or commissions based on Products purchased by your Downline, ensure you request a payout before closure. As long as you have reached the payout level for your account that Request will be reviewed and Verified by Admin. Payment will then be scheduled for the 5th Day of the Following Month. Once the Account is closed and processed, you forfeit all referrals, credits, downline subscriptions, and earnings. Any product you downloaded to your own computer during your Membership to Xtream Global is yours to keep forever.

If closed by mistake, you can un-close an account by contacting Admin immediately. If the Closed Account has been processed, you forfeit all referrals, downline subscriptions, and earnings. They will not be re-instated. If the Account Closure has not been processed by Admin, there will be no loss of credits, referrals, or earnings.

Xtream Members personnel and Admin may also close any account if it is found to violate our policies, either with frame-breaking, popup technology, actions used to cheat the system and/or artificially boost credit counts, actions to damage either the operation or reputation of our site (including the use of UCE (spam)), or other actions deemed by us to be unsuitable for our membership.

When an account is closed, any remaining credits, referrals, and earnings are forfeited.  Referred members will rise to the closed member's upline referrer, or be listed as free agents.

Limitation of Liability and Warranty

You agree that use of the service is entirely at the user's own risk.  Services are provided "as is", without warranty of any kind, expressed or implied.  This includes without limitation any warranty for Information, Services, Uninterrupted access, or products provided through or in connection with our service.  This also include without limitation the results obtained through our service.  We disclaim any warranties concerning the availability, accuracy, or content of information, products or services.  We disclaim any warranties of Merchantability or Fitness for a particular purpose.

This disclaimer applies to any damages or injury caused by any failure of performance, error, omission, deletion, delay of any kind, computer virus, theft or destruction, negligence, unauthorized access to our site, or any other cause of action.  You acknowledge that we are not liable for defamatory, offensive or illegal conduct of other customers or third parties, and that the risk of injury rests entirely with you.

Neither Xtream Members Online Marketing Digital Product Library Traffic Exchange, nor any of its agents, affiliates, or content providers shall be liable for any direct, indirect, incidental, special or consequential damages arising out of use of our services, or inability to gain access to or use our services, or out of any breach of any warranty.  Customer acknowledges that the provisions in this section apply to all content on the Xtream Members Online Marketing Digital Product Library Traffic Exchange web site.

You agree that we do not provide refunds on traffic received or credits used. Use of the service is entirely at the user's own risk.

On the digital products, each product will include the Author's consent and terms of use. Be advised that all Legal disputes and actions, including litigation and Court Proceedings will be conducted in the State of the Business Office, Xtream Global, which is located in the State of Texas, United States Of America. In case of Lawsuit or Legal Action instigated by Xtream Global, all parties will be subpoenaed to appear in a Court Of Law located in or convenient to:
